We have formulated our terms and conditions, important information and data protection declaration as simply and understandably as possible. To avoid misunderstandings, we ask that you read it carefully.
Of course, we hope that everything is always OK with your products and that you are always satisfied with them.
§1 Scope and provider
These General Terms and Conditions (GTC) apply to all orders that consumers (§ 13 BGB) place via the online shop at www.Lambda-Tuning.de (hereinafter LAMBDA-Tuning GmbH) or by email, as well as when purchasing directly on site.
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. Consumers are hereinafter also referred to as buyers or customers.
§2 Conclusion of contract
The product representations in the online shop are used to submit a purchase offer. Our products are sold for private use only. The buyer must be at least 18 years old to be able to order goods from LAMBDA-Tuning. If in doubt, the buyer must prove his age. The contract language is German.
The presentation of the products in the online shop does not represent a legally binding offer, but rather a non-binding online catalog. By clicking on the "order with payment" button, you place a binding order for the goods contained in the shopping cart. You can also place a binding order by telephone or email.
The confirmation of receipt of your order (order confirmation) takes place together with the acceptance of the order immediately after sending by automated email to the email address you provided. Alternatively, if you order by phone/e-mail with an order confirmation including delivery time, list of products ordered, shipping costs, total amount and payment options.
The purchase contract is concluded with this order confirmation.
The order confirmation contains a sample cancellation and, in the appendix, these general terms and conditions including cancellation instructions and data protection declaration.
§3 Prices
The prices stated on the product pages include the value added tax (VAT) for the Europen country where the good will be shipped.
If delivery is made outside the European Union (EU), additional customs duties, taxes or fees may be payable by the buyer, but not to LAMBDA-Tuning, but to the customs or tax authorities responsible there. The buyer is advised to check the details with the customs or tax authorities before ordering.

If sold outside the EU, the VAT is not included.
§4 Payment, delivery times and shipping costs

§ 5 Retention of title
The goods remain our property until full payment has been made. Before ownership is transferred, pledging, transfer as security, processing or redesigning without our consent is not permitted.
§6 Cancellation policy
Consumers have the following right of withdrawal.
Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
In order to exercise your right of withdrawal, you must inform us (see contact options below) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the attached sample cancellation form in the automatic email confirmation of receipt, although this is not mandatory.
In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires. You can use this sample cancellation form or another clear declaration and send it to us by email.
If you make use of this option, we will immediately send you confirmation (e.g. by email) that we have received your revocation.

Consequences of revocation
If you cancel this contract, we will have to pay you all payments we have received from you (except for delivery costs abroad or additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have chosen), immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract.
For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.
You must return or hand over the goods to LAMBDA-Tuning (see address above) immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired. You bear the direct costs of returning the goods.
You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.
The right of withdrawal does not apply to the delivery of goods that are manufactured according to customer specifications and for the production of which an individual selection by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
However, after consultation with LAMBDA-Tuning, a return can be made (return request). LAMBDA-Tuning generally charges 10% of the sales price for returns.
Please avoid damage and contamination. If possible, please send the goods back to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging in order to avoid claims for damages due to defective packaging.
Please note that the original packaging is not a requirement for the effective exercise of the right of withdrawal.
§7 Transport damage
If goods are delivered with obvious transport damage, please report such errors immediately to the delivery person and contact us as quickly as possible. Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance company.
§8 Warranty
The statutory warranty rights apply to the items offered in our shop.
Races and competitions do not exclude the warranty. However, please note the additional warranty information listed below.Liability for material defects.
§9 Final provisions
If any provision of these General Terms and Conditions is wholly or partially ineffective, the rest of the contract remains valid. The relevant statutory provisions apply in place of the invalid provision. The effectiveness of the remaining provisions or parts of such provisions remain unaffected.
Important instructions
Additional information on warranty and liability for material defects
Using and driving the carbon products offered is at your own expense and risk. Furthermore, LAMBDA-Tuning is not liable for indirect accident-related damage, indirect damage and consequential damage. Excluded are damages incurred in accordance with product liability law due to a defective product.
Cycling races do not exclude the warranty. However, the warranty expires in the event of a fall or damage caused by external influences and if the instructions given here are ignored.
The buyer is advised that any changes or damage to the carbon products must be inspected by an expert. The bicycle may not be moved without this inspection for damage. Damaged carbon components may not be repaired.

Consumers have the opportunity to use this platform to resolve their disputes.
All items offered have a two-year warranty against product defects. For explicitly marked used goods (e.g. as a special offer) the warranty is one year.

Use of the product for commercial purposes (except cycling racing)

Normally permissible or technically unavoidable fluctuations in quality and appearance

Small paint defects and different shades in the paintwork
Carbon should never be exposed to excessive heat. This is why a bicycle should not be left in the car on hot or sunny days.
The maximum permissible total weights for our products can be found in the corresponding manuals.
Shopping cart system
You can reserve products without obligation by clicking the “Add to cart” button. You can view your shopping cart at any time and remove products from the shopping cart. If you would like to purchase the products in the shopping cart, click the “Checkout” button.
You will be asked to enter your data. The mandatory information is marked with a (*). You can delete and correct your personal data at any time before placing your order.
You can completely end the ordering process at any time by closing the browser window. The contents of the shopping cart will be retained if you have agreed to the use of cookies.
When will my order be binding?
You can check your entries again on the order page. By clicking the “Order for a fee” button you complete the ordering process. The process can be canceled at any time by closing the browser window. On the checkout page you will receive further information and the option to change or delete the number of products.
You can also place a binding order by telephone or email.
Is the contract text saved?
We save the contract/order text and send you the order details and our general terms and conditions as a PDF file by email.
